Leaks from the Supreme Court

Yep.  Just three days after the historic SCOTUS decision and there's a story from major leaks on the deliberations and voting.  The Volokh Conspiracy has details on the CBS News reporting from Jan Crawford in three great posts HERE, HERE and HERE.

From the story:
I am told by two sources with specific knowledge of the court’s deliberations that Roberts initially sided with the conservatives in this case and was prepared to strike down the heart of this law, the so-called individual mandate, of course, that requires all Americans to buy insurance or pay a penalty. but Roberts, I’m told by my sources, changed his views deciding to instead join with the liberals.
This is amazing.  Does anyone know how to spell Earl Warren?

Scary words from a member of SCOTUS

CNS has the following about one of The Brethren:

Describing her move from serving as President Barack Obama's solicitor general to serving on the Supreme Court, Justice Elena Kagan said last week that “sometimes I think that the job doesn’t really change at all.”

As solicitor general, Kagan’s job was to advocate the Obama administration’s position in cases brought to the Supreme Court. As a justice, Kagan's job is to judge cases brought to the Supreme Court.

“So, sometimes I think that the job doesn’t really change at all--that as solicitor general my life was spent trying to persuade 9 people and now it’s just trying to persuade 8 people,” said Kagan.

Boy, is that scary.  In Kagan's view, her job isn't to rule on the law, it's to persuade her fellow justices.  She's not a referee, she's still one of the players.

Will it happen?

There's an old line that says that a conservative is a liberal who has been mugged.

Maybe we'll get that on the Supreme Court?

WASHINGTON –  Justice Stephen Breyer was robbed last week by a machete-wielding intruder at his vacation home in the West Indies, a Supreme Court spokeswoman said Monday.
The 73-year-old Breyer, wife Joanna and guests were confronted by the robber around 9 p.m. EST Thursday in the home Breyer owns on the Caribbean island of Nevis, spokeswoman Kathy Arberg said. The intruder took about $1,000 in cash and no one was hurt, Arberg said.

One can hope, can't they?
